The Pateley Club – application for a new premises licence

 

Report of the Corporate Director – Environment

 

 

1.0       PURPOSE OF REPORT

 

1.1       The purpose of this report is to determine a premises licence application under the Licensing Act

            2003.

 

 

 

2.0       BACKGROUND        

 

3.1       An application for the grant of a premises licence has been made for The Pateley Club, 42

            High Street, Pateley Bridge, HG3 5JU. A copy of the application and associated plan is                attached at Appendix 1.

 

3.2       The applicants are Frank Wallace Jauncey, The Sycamores, Pateley Bridge, HG3 5RE and Russell Stephen Goodwin, The Exchange, Little King Street, Pateley Bridge, HG3 5AU.

 

3.3       Photographs of the site and vicinity are attached at Appendix 2.

 

3.4       The Pateley Club is described as a members club with facilities including a bar serving real ale, a function room, snooker and pool tables as well as televisions. Housed in a Grade II listed building built in 1664 as the George and Dragon Inn, ale was brewed on the site in 1777 later becoming the brewery managers house. After a time as the Conservative Club, it is now The Pateley Club.

 

3.5       The premises currently has the benefit of a Club Premises Certificate granted in July 2005, licence number WK050603877. The Club Premises Certificate is attached at Appendix 3.

 

3.6       The current Club Premises Certificate authorises the following:

 

Supply of alcohol

 

Monday to Sunday - 1100hrs until 0100hrs

 

Live Music

 

Saturday – 2000hrs until 0100hrs

 

Indoor sporting events

 

Tuesday – 1930hrs until 2230hrs

 

 

 

3.7       The premises licence application seeks the following:

 

            Retail sale of alcohol

 

            Sunday to Thursday               1200hrs until 0000hrs

            Friday and Saturday               1200hrs until 0100hrs

 

            Live and recorded music

 

            Sunday to Thursday               2300hrs until 0000hrs

            Friday and Saturday               2300hrs until 0100hrs

 

            Opening hours

 

            Sunday to Thursday               1200hrs until 0030hrs

            Friday and Saturday               1200hrs until 0130hrs

 

            Non-standard timings

 

            New Year’s Eve until 0100hrs, any Sunday preceding a Bank Holiday until 0100hrs

 

3.8       Following consultation with North Yorkshire Police the applicant agreed to the following                reduction in hours:

 

            All licensable activities

 

            Sunday to Thursday               1200hrs until 2300hrs

            Friday and Saturday               1200hrs until 0100hrs

 

            Opening hours

 

            Sunday to Thursday               1200hrs until 2330hrs

            Friday and Saturday               1200hrs until 0130hrs

 

Note:  The Live Music Act 2012 removes the licensing requirement for amplified live music taking

           place between 0800hrs and 2300hrs before audiences of no more than 500 persons on

           premises authorised to supply alcohol for consumption on the premises. Background music   

           is also exempt.

 

3.9       The applicant has advised that the Club Premises Certificate will be surrendered should the Premises Licence application be granted.

 

4.0       PROMOTION OF LICENSING OBJECTIVES

 

4.1       Section 4 of the Licensing Act 2003 places a duty on the Licensing Authority to carry out its             functions under the Act with a view to promoting the licensing objectives. The licensing                objectives are:

 

·         The prevention of crime and disorder

·         Public Safety

·         The prevention of public nuisance

·         The protection of children from harm

 

4.2       Each objective is of equal importance. It is important to note that there are no other licensing            objectives, so that these four objectives are always paramount considerations.

 

 

 

 

5.0       CONSULTATION UNDERTAKEN AND RESPONSES

 

5.1       Copies of the application were sent to all statutory responsible authorities in accordance with       the provisions of the Licensing Act 2003.

 

5.2       Applicants are required to publish a notice in a local newspaper and to display a brief                   summary of the application on an A4 size notice in a prominent position immediately on or                       outside the premises for 28 consecutive days. A record of the application was also published       on the Council’s website and the full application made available at the Council offices.

 

5.3       The applicant consulted with North Yorkshire Police and, as well as the reduction in hours,             agreed additional conditions that will form part of any granted licence. This correspondence         and the agreed conditions are attached at Appendix 4.

 

5.4       There have been three representations received from other interested parties which are   attached from Appendix 5 to Appendix 7. The applicant provided a number of responses to these representations which are detailed within the appendices.

 

5.5       There have been thirteen letters submitted in support of the application. These are attached from Appendix 8 to Appendix 20.

 

7.0       ALTERNATIVE OPTIONS CONSIDERED

 

7.1       Not applicable

 

9.0       FINANCIAL IMPLICATIONS

 

9.1       Not applicable

 

10.0     LEGAL IMPLICATIONS

 

10.1     As relevant representations have been received the Licensing Sub-Committee must hold a             hearing to determine the application.

 

10.2     The Licensing Sub-Committee must have regard to the promotion of the four licensing                 objectives in exercising its functions under the Licensing Act 2003.

 

10.3     The Licensing Sub-Committee must also have regard to the statutory guidance issued under

            section 182 of the Act and the Council’s own Statement of Licensing Policy when exercising        its functions under the Act.

 

10.4     In accordance with Schedule 5 of the Licensing Act 2003 the applicant, and any person who

has made a relevant representation, may appeal against any decision of the Licensing Sub-Committee.

 

10.5     Any appeal against a decision by the Licensing Sub-Committee must be made to the Magistrates Court within the period of 21 days beginning on the day on which the appellant is notified by the Licensing Authority of that decision.

 

11.0     EQUALITIES IMPLICATIONS

14.0     POLICY IMPLICATIONS

 

14.1     The following sections of North Yorkshire Council’s Statement of Licensing Policy are                   relevant in considering the licensing objectives in relation to this application:

·         Crime and disorder – section 33

·         Public Safety – section 44

·         Protection of children – section 53

 

14.2     Other considerations

 

The following sections of the guidance issued under Section 182 of the Licensing Act 2003 (updated February 2026) issued by the Home Office are relevant in considering the licensing objectives in relation to this application:

 

·         Crime and disorder – section 2.1

·         Public safety – section 2.8

·         Public nuisance – section 2.21

·         Protection of children from harm – section 2.28

 

14.3     A recent update to the section 182 Guidance has been added to help ensure that, when               determining licence applications and considering any conditions that may apply, Licensing            Authorities have in mind the need to support the development of a thriving hospitality sector        while still upholding the existing statutory licensing objectives.

 

14.4     Section 1.18 of the Guidance states that when making licensing decisions, all Licensing               Authorities should consider the need to promote growth and deliver economic benefits.

 

14.5     Appendix 21 contains the mandatory conditions which will be applied to all licences in                 addition to any conditions agreed by the Licensing Sub-Committee.

 

19.0     CONCLUSIONS

 

19.1     An application has been made for the grant of a premises licence by Frank Wallace Jauncey

            and Russell Stephen Goodwin for The Pateley Club, 42 High Street, Pateley Bridge, HG3            5JU. The conditions agreed with North Yorkshire Police and mandatory conditions will form     part of the licence as well as any conditions imposed by the Licensing Authority.

 

19.2     The Licensing Sub-Committee must, having had regard to the application and any relevant            representations, take such steps (if any) it considers appropriate for the promotion of the             licensing objectives.

 

21.0

OPTIONS

 

 

To take any of the following steps as the Licensing Sub-Committee considers appropriate

for the promotion of the licensing objectives:

 

i)      Grant the variation to the licence as applied for.

ii)     To grant the variation to the licence and modify the conditions of the licence (for this purpose the conditions of the licence are modified if any of them are altered, omitted or any new condition is added).

iii)   To reject the application in whole or part.
